1. Acceptance of Terms

By accessing and using the Sunday Cookout platform ("the Platform"), website, and mobile application ("the Services"), you agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, you must not use our Services. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of such modifications.

2. Eligibility and Age Requirements

You must meet the following requirements to use our Services:

• You must be at least 18 years of age
• You must be a resident of the Republic of South Africa or physically present in South Africa to participate in events
• You must provide accurate and truthful information during registration
• You must have the legal capacity to enter into binding agreements

We reserve the right to verify your age and eligibility and may request proof of identity or residency.

3. Account Responsibilities

When you create an account on our Platform, you are responsible for:

• Maintaining the confidentiality of your login credentials and password
• Ensuring that information you provide during registration is accurate and complete
• Notifying us immediately of any unauthorized access to your account
• Taking reasonable steps to protect your account from unauthorized use
• Being liable for all activities conducted under your account

We reserve the right to suspend or terminate your account if we believe you have violated these Terms or engaged in fraudulent activity.

5. QR Code Usage

When scanning stall QR codes to claim, you agree to the following:

• Physical Presence: You must be physically present at the stall when claiming, and show the confirmation screen to stall staff to collect your item.
• One Claim Per Stall: Each stall may only be claimed once per ticket per event. Duplicate scans will be rejected automatically.
• Fair Use: You must not attempt to circumvent the claim verification system in any way.
• Device Compatibility: Claiming requires a compatible mobile device with a functional camera and internet connectivity.

6. Prohibited Activities

You must not engage in any of the following activities:

• Account Sharing: Sharing your login credentials or allowing others to use your account or ticket
• Fraudulent Claiming: Attempting to claim more than once at the same stall, or colluding with others to claim on someone else's behalf
• Ticket Fraud: Attempting to use unpaid, cancelled, or fabricated ticket codes; attempting to modify claim records
• Hacking and Unauthorized Access: Attempting to gain unauthorized access to the Platform or its systems
• Harassment and Abuse: Engaging in abusive, threatening, or harassing behavior toward other users, vendors, or our staff
• Intellectual Property Violation: Reproducing, distributing, or modifying any content without authorization
• Malware and Viruses: Uploading or transmitting malware, viruses, or other malicious code
• Spam and Solicitation: Sending unsolicited messages, advertisements, or promotional content

We monitor for fraudulent activity and reserve the right to suspend or permanently terminate accounts found to be in violation of these prohibitions.

7. Intellectual Property

All content on the Platform, including logos, text, images, graphics, software, and code, is the exclusive property of Sunday Cookout or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes. You may not:

• Reproduce, distribute, or transmit any content without written permission
• Modify, translate, or create derivative works based on the Platform
• Reverse-engineer, decompile, or disassemble any part of the Platform
• Use the Platform for commercial purposes without authorization

8. Limitation of Liability

To the maximum extent permitted by law:

• Sunday Cookout is provided "as is" without warranties of any kind, express or implied
• We do not warrant that the Platform will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
• Our total liability is limited to the amount of any fees you have paid in the past 12 months

Some jurisdictions do not allow limitation of liability, so this limitation may not apply to you.

9. Event Cancellation and Force Majeure

Sunday Cookout may cancel, postpone, or modify events due to unforeseen circumstances including weather, natural disasters, public health emergencies, or security concerns. In the event of cancellation, active Xperience tickets will be honoured at the rescheduled event, or credited toward a future event. We are not liable for any losses incurred due to event cancellation.

You agree to indemnify and hold harmless Sunday Cookout, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms, your use of the Platform, or your infringement of any third-party rights.

11. Third-Party Links and Content

The Platform may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is governed by their own terms and conditions. We recommend reviewing their privacy policies and terms before providing personal information.

12. Dispute Resolution and Arbitration

Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of the Republic of South Africa. Both parties agree to attempt informal resolution of disputes before pursuing formal legal action. If informal resolution fails, disputes shall be submitted to binding arbitration in South Africa in accordance with the Arbitration Act, 42 of 1965.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. The exclusive jurisdiction for any legal proceedings arising from these Terms is the South African courts. You consent to the jurisdiction of the South African courts and waive any objections based on improper venue or inconvenient forum.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform following any changes constitutes your acceptance of the modified Terms. We recommend reviewing these Terms periodically for updates.
